An Independence Day offer SMS should wish customers well, state the offer, dates and terms in plain words, and leave out the national flag and emblem. The Flag Code says the flag shall not be used in any form of advertisement. Send to opted-in customers through a registered sender and approved template, and plan the send a few days before 15 August.

Independence Day on 15 August, like Republic Day on 26 January, brings sales, wishes and a wave of patriotic forwards. Many businesses send an Independence Day offer SMS, and many get the tone or the rules wrong. This guide covers what to say, when to send and what to leave out. It is part of our seasonal marketing series, which starts with the Diwali SMS campaign guide. If you want to add WhatsApp for catalogue and replies, our WhatsApp marketing service page describes broadcasts, templates and opt-ins.
Can you use the national flag in an Independence Day offer?
Do not, in the message or the creative, unless a lawyer has cleared it. The Flag Code of India, as reproduced on a state police website, says the flag shall not be used for commercial purposes in violation of the Emblems and Names (Prevention of Improper Use) Act, 1950, and also says it shall not be used in any form of advertisement (sections 2.1 and 3.29, read 25 October 2026). The Act lists the national flag as an emblem and restricts its use in trade and business without permission.
A text-only SMS sidesteps the question. If you send images on WhatsApp, use your own designs, without the flag, the Ashoka Chakra or the national emblem. Check the official Code and the Act for the exact wording and any updates.
What kind of Independence Day offers work?
Simple ones with a clear reason. Customers are used to "Freedom Sale" messages and mostly ignore them. What gets read is a specific offer from a business they know:
- A short-period discount with real dates and terms.
- A "freedom from" idea that fits your business, such as freedom from queues for a bank branch app or from servicing worries for a vehicle dealer. Keep it tasteful.
- An offer for service personnel if you can honour it and verify it.
- A thank-you note with no sales pitch, for loyal customers.
Avoid using a patriotic message to sell something unrelated or to shame people who do not buy. It reads badly and can draw complaints.
What should the SMS say?
Name your business, wish the customer, state the offer and give the dates. Examples with placeholders (match them to your registered template):
- "Happy Independence Day from [Business]. Enjoy [benefit] on [products] from [date] to [date]. Terms: [link]."
- "[Business] wishes you a happy Independence Day. Visit us at [place] for our special offer until [date]."
- "Happy Independence Day. Thank you for being a [Business] customer. Our stores are closed on [date] and open again on [date]."
Say what the offer actually is. Skip "grand", "mega" and "biggest". Our guide to festive season SMS marketing shows more ways to write a clear offer, and the Ganesh Chaturthi marketing campaign guide shows how to plan a run of festival messages.
When should you send it?
A few days before 15 August for a multi-day offer, or the morning of 14 August for a one-day sale. Do not send on the morning of the holiday itself unless the offer is for that day. People are with family, and most of them are not shopping. Plan the content in July so that your template is approved well before the date.
Who should receive it?
Customers who agreed to hear from you. Under TRAI's regulations a promotional message goes to people who have not blocked that category unless you hold explicit consent, and it must carry an opt-out. A pure greeting may be classified differently from an offer, so ask your provider. On WhatsApp, Meta's policy requires opt-in and respect for requests to stop.
If you send a lot of reminders and notices in the same month, remember to space them. Our guide to year-end payment reminders explains how to avoid sending a customer a dues notice and an offer on the same day.
A worked example (hypothetical)
A furniture showroom wants to run a three-day sale around 15 August. This is an invented example. It prepares its template in July, with the dates and a link to the terms. It sends an SMS on 11 August to 4,000 customers who agreed to offers, with a plain wish and the sale dates. It uses no flag image. On the morning of 14 August it sends a reminder only to the 600 people who clicked the terms page. The showroom closes on the holiday itself and says so in the message. The result is a small, traceable campaign with no complaints.
Common mistakes in Independence Day campaigns
- Using the flag in the creative. The Flag Code restricts it.
- Vague offers. Give dates and terms.
- Sending on the holiday morning. Most people are not shopping.
- Preaching. Customers want a wish and an offer, not a lecture.
- Using it for unrelated sales. Keep the offer natural.
- Late template approval. Register in July.
- Buying numbers. You cannot show consent.
Frequently asked questions
Can a business use the Indian flag in an SMS or WhatsApp image?
The Flag Code, as reproduced by a state police website, says the flag shall not be used in any form of advertisement and shall not be used commercially in violation of the 1950 Act. Avoid it in promotions, and ask a lawyer if you are unsure.
When should I send an Independence Day offer SMS?
A few days before 15 August for a multi-day offer, or on 14 August for a one-day sale. Avoid the holiday morning, and prepare your template in July so that approval is not a last-minute problem.
Is a festival greeting SMS promotional?
A greeting with an offer is promotional. A plain greeting may be classified differently, and that depends on the template and your provider. Ask how it will be treated, and include an opt-out on anything promotional.
Does the same advice apply to Republic Day?
Yes. The same flag and emblem rules apply, and the same advice on consent, timing and plain offers. Plan the template well before 26 January.
Can I send Independence Day offers on WhatsApp?
To customers who opted in, using approved templates to start the conversation, under Meta's policy. Keep the creative flag-free, and keep SMS as a fallback for customers who are not on WhatsApp.
